Energy Industry Update: June 2008

ScottMadden’s Energy Industry Update

The Energy Industry Update is a compendium of breaking news, emerging issues, and recent developments in the energy industry.

This summer of 2008 finds firms still suffering from escalating costs, infrastructure needs, and regulatory uncertainty. A slowdown in economic growth has staved off some power supply adequacy issues, but increasing natural gas prices continue to drive power prices upward, with little relief in sight. Despite – or because of – these challenges, more firms are beginning to perceive sustainability as an enduring trend and are pursuing more comprehensive and systematic actions going beyond “mere” sustainability reporting. This issue of ScottMadden’s Energy Industry Update traces some of those industry activities, from energy efficiency to renewables development to green sourcing to understanding carbon constraints.

The energy industry is changing, and its regulatory and financial moorings are shifting. Competitive markets combined with other factors may lead to early nuclear unit retirement. Continuing changes in energy supply and demand patterns create a complex operation environment for electric utilities. Federal and state policy lines are beginning to blur as states have been increasingly intervening in FERC domain seeking favorable outcomes for their citizens and other local constituencies. In our Update, themed “As Yogi Berra Might Say…,” we look at the unusual picture drawn by the juxtaposition of these changes.
