After spending time in legal limbo, the Trump administration has proposed a repeal of the controversial Clean Power Plan. The U.S. Environmental Protection Agency (EPA) is also considering a possible replacement rule that could be much more tailored to power generator characteristics. But, what would that mean? Access this Update to learn about the regulation of power generator greenhouse gas (GHG) emissions, changes in fossil generation (particularly coal-fired generation), and steps being taken by cities and states to address GHG emissions.
“The power generation industry will continue to live with uncertainty as the EPA develops a path forward on GHG emissions regulation and a wide variety of stakeholders contend on the import of, and course of action for, resilience,” explains Preston Fowler, director at ScottMadden. “But many power plant owners, particularly those with younger, larger units, will continue to work to improve plant performance to meet challenging market conditions pending a possible replacement rule, while others will contemplate end-of-life operating and capex approaches.”
